unsur	Fakta, kejadian dan atau isu hukum yang perlu dibuktikan untuk memenangkan perkara. Misalnya, di negara yang bertradisi common law, penuntut umum biasanya harus membuktikan setidaknya dua unsur untuk menang perkara pidana, yaitu bahwa terdakwa: 1. secara fisik melakukan tindakan yang merupakan kejahatan terkait (actus reus); dan 2. mempunyai mens rea untuk melakukan tindakan tersebut.
